Do Boat Trailers Need Brakes? State Laws & Customer Responsibility

Trailer brake requirements vary by state, and it is the customer’s responsibility to ensure their boat trailer is equipped with brakes that meet state and local laws.

In most states, trailers over a certain weight threshold (commonly 1,500–3,000 lbs gross weight) are legally required to have brakes on at least one axle, though the exact limits and rules vary. Some states also require brakes on all axles once the trailer reaches a higher weight.
